Thanks for using the CNKI EXPRESS International Version. CNKI EXPRESS International Version is a product and/or service for users outside of the Chinese mainland provided by China Academic Journal (CD Edition) Electronic Publishing House Co., Ltd., Tongfang Knowledge Network Technology Co.,Ltd.(Beijing) and Tongfang Knowledge Network Digital Publishing Technology Co., Ltd. (with registered addresses respectively at Room 1407,1408,1409, Area 36, Tsinghua University, Tsinghua Park, Haidian District, Beijing; Building 2, Block A, Northern Territory, Dongsheng Tech Park, 66 Xixiaokou Road, Haidian District, Beijing; Room B201,B202, B203, B205, B206, B207, B208, B209,B210 (Dongsheng area), 2/F, Building B-2, Zhongguancun Dongsheng Tech Park, 66 Xixiaokou Road, Haidian District, Beijing; contact address at Building 2, Block A, Northern Territory, Dongsheng Tech Park, 66 Xixiaokou Road, Haidian District, Beijing) (collectively as "CNKI") through APP.

This Policy applies to countries and regions outside the Chinese mainland, including Hong Kong, Macau and Taiwan.

CNKI is fully aware of the importance of personal information to you. The Privacy Policy of CNKI EXPRESS International Version (this “Policy”) is drafted in accordance with the Personal Information Protection Law of the People’s Republic of China, the Cybersecurity Law of the People’s Republic of China, the Provisions on the Scope of Mandatory Personal Information for Common Types of Mobile Internet Applications, the General Data Protection Regulation (“GDPR”), the California Consumer Protection Act (“CCPA”) and other applicable laws and regulations. This Policy describes the purposes, methods, collection scope and information security protection measures of CNKI EXPRESS International Version’s collecting, using, storing, entrusted processing, sharing, transferring and public disclosure of your personal information, as well as the methods we provide to enable your control over your personal information, such as accessing, correcting and deleting your personal information. Please read this Policy together with ourUser Agreement of CNKI EXPRESS International Version.

Please read carefully and fully understand this Policy to make choices that you deem appropriate before using the products and/or services of CNKI EXPRESS International Version. In addition, please also note the following:

This Policy consists of two parts: (I) the General Terms; and (II) the Special Terms:

a)The General Terms contain terms and conditions that are applicable to all users of CNKI EXPRESS International Version in any other jurisdiction except the Chinese mainland.

b)The Special Terms, forming part of this Policy, contain terms and conditions which are specific to the relevant jurisdictions in which CNKI EXPRESS International Version provides products and/or services. For the avoidance of doubt, the application of the clauses stated in the Special Terms shall apply specifically only to the users who are using CNKI EXPRESS International Version in relevant jurisdictions.

c)To the extent that there is any inconsistency between the General Terms and the Special Terms, the Special Terms shall prevail to the extent necessary to resolve such inconsistency.

If you refuse to provide unnecessary personal information or information required for expanded functions, you are still able to use the basic functions of CNKI EXPRESS International Version

This Policy only applies to the personal information we collect.

PART I GENERAL TERMS

2. How Do We Collect and Use Your Personal Information

When you use the services provided by CNKI EXPRESS International Version, to better serve your purposes, we may collect and use your personal information based on the principles of legality, fairness, necessity and transparency and based on purposes described in this Policy. If we use your personal information for purposes other than the scope described in this Policy, or collect your personal information for other special purposes, we will notify you in a reasonable manner and obtain your consent again before collecting or using such information.

2.1 Personal Information Provided Directly by You
  • 2.1.1 To perform our following basic business functions, we need to collect your personal information, and if you refuse to provide us such data, we will not be able to provide you relevant services.
    (1)Account Registration and Use

    When you register the account of CNKI EXPRESS International Version, you need to provide your email address, name, institution, role, location, research of field, and to set your account password.

  • (2)Search

    When you use the service, to provide you with the search function, we will collect your behavior log information, URL of visited page, search terms.

  • (3)Literature Uploading

    When you use WiFi to upload literature, we will record your WiFi name. This function is not available in the touch screen version.

  • (4)Products Purchasing and Payment

    · When you purchase Smart Points through CNKI EXPRESS International Version, we need to collect your payment records, account balance and discount information. If you do not agree to the collection of the afore-mentioned information, we will not be able to provide the service about purchasing and downloading the electronic contents for you.

    · When you use the payment function, the third party who provides the payment service to you will collect the information related to payment (such as the order amount, order title, order additional information, etc.). Please refer to the privacy policy of the third party for their specific practices and protection measures for the collection and use of personal information.

    · When you need to use mailing service (invoices and/or products), you shall provide the name, contact number and shipping address of the receiver, so that your order can be delivered.

    · If you need to issue an invoice, you shall provide us with the name, address and order information. If you need to issue an electronic VAT invoice, you shall provide the invoice title, email address and Chinese mainland mobile phone number.

    Note: if you provide personal information of other data subjects, please make sure you have obtained the consent of the relevant individual. Your provision shall be deemed as having obtained valid authorization and consent from relevant person.

  • 2.1.2 To provide better service and enhance your using experience, we may need to collect the relevant information for the following functions. If you refuse to provide the following information, your use of the basic business functions under Section 2.1.1 will not be affected, but we are not able to provide the following expanded business functions and services to you.
    (1) Institution Association Services

    CNKI EXPRESS International Version provides institution association services for your Account. It includes location association, association through QR code scanning, account association, IP association, and off-campus association models. The personal information we collect in different account association models is as follows:

    · Location association: in order to proceed location association, we need to collect your location information;

    · Association through QR code scanning: in order to proceed association through QR code scanning, we need to retrieve your camera permissions and collect the QR code scanning results;

    · Account number association: in order to proceed account number association, we need to collect your institution account username and password;

    · IP association: In order to proceed association through IP address, we need to collect your IP location and Wi-Fi information;

    · Off-campus association: In order to proceed off-campus association, we need to collect your input account username and password.

  • (2)Personalized Contents Recommendation

    In order to provide you with contents that suit your interests better, we will recommend relevant or contents that are of your interests based on your searching, browsing, downloading, collecting and other behaviors. You can turn off personalized content recommendations through “My - Settings - Push Settings - Push Notification”. When you turn off personalized contents recommendations, we will no longer recommend personalized contents for you.

  • (3)Sharing

    If you have any question or suggestion about our products and/or services, you are welcome to contact us. To ensure that we can effectively follow up and troubleshoot your problem, we may keep records of your correspondence/call records and contents or contact information you submitted, including name, email address, contact number, and record the handling plan and outcome of the relevant issue.

  • (4)Improving Our Service

    If you have any question or suggestion about our products and/or services, you are welcome to contact us. To ensure that we can effectively follow up and troubleshoot your problem, we may keep records of your correspondence/call records and contents or contact information you submitted, including name, email address, contact number, and record the handling plan and outcome of the relevant issue.

  • (5)Improving Our Service

    We may use the information collected under certain function of CNKI EXPRESS International Version for other functions and/or services of CNKI EXPRESS International Version. For example, we may allow you to participate in surveys about CNKI EXPRESS International Version to help us improve existing services or design new ones; at the same time, we may use your information for product updates.

    You understand and agree that after collecting your information, we will de-identify the data through technical means, and the de-identified information will not be able to identify you, in which case we have the right to use the de-identified information to analyze and commercially exploit the user database.

2.2 Personal Information Proactively Collected by Us During Your Use of the Services

Subject to the laws and regulations, to protect your account security and provide you better service, we may collect and use the following information generated by you in the course of using CNKI EXPRESS International Version:

  • (1)Location Information

    When you request for institution association, we collect and use your geolocation information to realize the location association method properly.

  • (2)Device Information

    When you use third-party to login, make payment, share, push and APP crash statistics, in order to ensure the proper use of these functions, we will collect, and use your mobile device information, including the unique application programming number, IP, MAC address, Android _ ID and IMSI.

  • (3)Application Information

    When you use the sharing function, third-party login, and APP crash statistics, we collect and use your APP information, including APP name, APP version, etc.

  • (4)Software Installation List

    When you use the function of sharing, we'll get a list of your software installations.

2.3 Our Request of Permissions

Certain functions of the CNKI EXPRESS International Version require your prior consent for us to access relevant system permissions to collect and use your personal information. You can check the specific personal information access permissions and their opening status through “My - Settings - System Permissions Management”, and decide to turn them on or off.

By turning on these permissions, you authorize us to collect and use such personal information, and we will only use your system permissions when you use the relevant functions. By closing these system permissions, you are withdrawing your authorization and we will no longer collect and use your personal information, but will also not be able to provide you with the functions that correspond to these authorizations. The decision to turn off the above-mentioned permissions will not affect the processing of personal information based on your previous authorizations.

2.4 Your Personal Information We Collected from Third Parties

You may log in CNKI EXPRESS International Version account by using a third-party platform account, and can choose to authorize us to read and obtain your public information (including nicknames, profile pictures) published or recorded on the third-party’s platform and mobile device information, subject to relevant laws and regulations. The purpose that we require your authorization to obtain the above information from the third-party’s platform is to remember your login identity as a CNKI EXPRESS International Version user.

After login with the third-party account, you are required to bind the third-party account with your CNKI EXPRESS International Version account. We may collect and use such personal information in accordance with the agreement with our affiliates or third-party partners on the premise that the information provided by the third party is from a legitimate source.

When you use the payment function, the third-party company that provides payment services to you will collect payment-related information. In order to realize the payment function, we will collect your order number, user ID and transaction line number returned by the company providing the payment service.

2.5 Exceptions Where Consent is not Required

Please kindly note that under the following circumstances, the collection and use of your personal information does not require your consent:

(1)Relating to the performance of our obligations under laws and regulations;

(2)Directly related to national security and national defense security;

(3)Directly related to public safety, public health or material public interest;

(4)Directly related to criminal investigation, prosecution, trial and judgment execution, etc.;

(5)To protect material legitimate rights and interests such as the life and property of data subjects or other individuals, but it is difficult to obtain consent from the individual;

(6)The personal information involved is disclosed to the public by the data subject itself;

(7)Collecting personal information that is lawfully and publicly disclosed, such as from lawful news reports, disclosed government information and other channels;

(8)It is necessary to execute and perform the contracts required by the data subject;

(9)It is necessary to maintain the safe and stable operation of the platform, such as finding and disposing of failure of products and/or services;

(10)Other circumstances stipulated by laws and regulations.

3. Collection and Use of Minors' information

If you are a Minor user, please read and agree to this Policy carefully under the company and guidance of your legal guardian. You and your legal guardians shall take responsibilities in accordance with the laws, regulations and this Policy. Once a Minor uses this website, we assume that he or she has the consent or guidance of a legal guardian.CNKI EXPRESS International Version is not provided to children (the definition of children is subject to your jurisdiction). If we accidentally collect personal information from a child (the definition of children is subject to your jurisdiction), we will delete such information as soon as possible.

We protect Minors' personal information in accordance with the applicable laws and regulations, and will only collect, use, store, share, transfer or disclose Minors' personal information permitted by law, with the consent of legal guardian, or when necessary for protecting the Minor. If we notice that a Minor's personal information has been collected without the prior and verifiable consent of the legal guardian, we will endeavor best efforts to delete the relevant information as soon as possible.

4. How Do We Use Cookies and Similar Technologies

The CNKI EXPRESS International Version does not use cookies and similar technologies, but some functions allow you to jump to our web-based products. Web-based products may use cookies to help you personalize your online experience, for details on the use of cookie technology of our web-based product, please read Privacy Policy of CNKI International Version.

5. How Do We Entrust, Share, Transfer and Publicly Disclose Your Personal Information
5.1 Entrusted Processing

In order to provide you with better and quality products and/or services, certain functionality may be provided by our technical service partners and we may entrust these partners to process some of your personal information. We will enter into strict confidentiality agreements with the companies, organizations and individuals to whom we entrust to process your personal information, in order to specify the responsibilities of both parties, the matters, period, nature and purpose of the processing and require them to process the personal information only in accordance with our instructions, this Policy and any other relevant confidentiality and security measures. If you refuse to allow our partners to collect the personal information necessary for the provision of the service, you may be unable to enjoy those services provided by such partner by using the CNKI EXPRESS International Version. Our partner includes:

SF Express and EMS: if we need to send physical goods (such as invoice, etc.) to you, we may entrust SF Express or EMS to provide logistics services for you, and we may provide them with the name, address and mobile phone number of the consignee. If you refuse to provide such information, our logistics partners will not be able to deliver the goods for you.

5.2 Share

Respecting users' privacy is one of the fundamental principles of CNKI. We will not share your personal information with any company, organization or individual, except for the following circumstances:

(1)We may share your personal information in accordance with laws and regulations or mandatory requests from competent government authorities.

(2)Share with authorized partners:

To provide you with better and quality products and/or services, certain services will be provided by our partners and, as a result, we may share some of your personal information with our partners. We will only share your personal information where it is legal, justified, necessary, specific and explicit purpose, and only where it is necessary to provide services to you. Such sharing partner is the data controller and obtains your consent in its own name to process your personal information.

Each partner may have its own separate privacy policy/personal information protection policy and user agreement. We recommend that you carefully read and comply with the third party's user agreement and privacy policy/personal information protection policy. If you refuse to allow our technology partners to collect the personal information necessary for the provision of the service, you may be unable to enjoy those services provided by our technology partner by using CNKI EXPRESS International Version. 5.3 Transfer

We will not transfer your personal information to any company, organization or individual, except for the following circumstances:

(1) Transfer with express consent: we may transfer your personal information to other parties after obtaining your express consent;

(2) In the event of merger, acquisition or bankruptcy liquidation, in case of transfer of personal information is involved, we will require the new company or organization holding your personal information to continue to be bound by this Policy. Otherwise, we will require such company or organization to obtain your consent again.

Please be aware that if any transfer is required under the above circumstances, before the transfer, we will inform you of the purpose, type, transferee of the information to be transferred (if any sensitive information is involved, we will also inform you of the content thereof) and will conduct transfer after obtaining your consent, unless otherwise stipulated by laws and regulations.

5.4 Public Disclosure

We will only publicly disclose your personal information under the following circumstances:

(2) Disclosure based on laws: we may publicly disclose your personal information as compulsorily required by laws, legal proceedings, litigation or governmental authorities.

According to laws and regulations, under the following circumstances, we may share, transfer or publicly disclose personal information without obtaining your prior consent:

(4)Directly related to criminal investigation, prosecution, trial and judgment execution, etc.;

(5)To protect material legitimate rights and interests such as the life and property of data subjects or other individuals, but it is difficult to obtain consent from the individual;

(6)The personal information involved is disclosed to the public by the data subject itself;

(7)Collecting personal information that is lawfully and publicly disclosed, such as from lawful news reports, disclosed government information and other channels;

(8)Necessary for the conclusion and performance of contracts as required by personal information subjects;

(9)Necessary for maintaining the safe and stable operation of the product or service provided, including the detection and dispose malfunctions of the product or service;

(10)Other circumstances stipulated by laws and regulations.

6. How Do We Protect Your Personal Information

We attach great importance to the security of your personal information. We have adopted multi-level protection measures such as technical safety measures conforming to industry standards and supporting organization structure and management system, to prevent your personal information from disclosure, destruction, misuse, unauthorized access, unauthorized disclosure or alteration to the greatest extent possible. In particular, the measures include the following:

6.1 Technical Measures for Data Security

(1)For the data transmission security, we adopt the cryptographic technology such as transport layer security protocol and deploy Https and other ways to prevent the transmission links from being eavesdropped, intercepted, and to establish a safe and private data environment and ensure the confidentiality and completeness of data. We also take additional safety measures to protect your information such as encrypted storage.

(2)With regard to the security control of data access and use, we have implemented a strict data authorization control mechanism, adopted multiple identity authentication technology, and monitored the processing of your personal information to prevent illegal access and unauthorized use of data. We also monitor the entire lifecycle of data to protect your personal information from unauthorized access, public disclosure, use, modification, and intentional or accidental damage or loss, etc.

(3)CNKI has also passed the China graded cybersecurity protection certification (Level III) and filed with regulatory authorities and conducts regular assessments.

6.2 Organization and Management Measures for Data Security

We have established a Cybersecurity and Data Compliance Management Committee to lead the company's cybersecurity, personal information protection and data security works. In addition, we have established a series of systems concerning data security production, and actively provided relevant special training sessions for our employees to raise their awareness of personal information protection and professional competence in this regard.

6.3 Security Incidents Handling

(1) If a personal information security incident occurs, we will, pursuant to the requirements of the laws and regulations, inform you promptly of the basic information and possible impact of the incident, measures we have taken or will take to deal with the incident, suggestions for prevention and reduction of the risk on your own, and remedial measures for you, etc. We will inform you of the relevant information of the incident in a timely manner by email, letter, telephone, push notice and other means. Where it is difficult to inform data subjects one by one, we will publish an announcement in a reasonable and effective way.

(2) Meanwhile, we will also proactively report the responses to any personal information security incident as required by regulatory authorities.

Please be aware that, although we have implemented various security measures, the Internet is not an absolutely secure environment and email, IM and other methods of communication with CNKI users are not encrypted. We strongly recommend that you do not send personal information by such means. Please help us keep your account secure by using a complex password.

7. How Do We Store Your Personal Information

We will store personal information collected and generated within the territory of Chinese mainland. If, due to business or other needs, we have to transmit or store personal information outside of the Chinese mainland, we will obtain your prior consent and strictly perform relevant obligations of the personal information cross-border transmission in accordance with relevant laws and regulations. We warrant that, unless otherwise stipulated by laws and regulations, we will store your personal information for the minimum period of time necessary to achieve the purposes for which you authorized.

If CNKI EXPRESS International Version was ceased due to business strategy or other reasons, unless otherwise stipulated by laws and regulations, we will notify you such circumstance, stop collecting your personal information, and delete or anonymize collected personal information.

8. Your Rights

Whenever you use CNKI EXPRESS International Version, we will try our best ensuring that you can access to your account information. If we provide you with incorrect information, we will endeavor to provide any means to allow you to update or delete information in your account promptly (unless we have to retain such information, whether by law or regulation). You are entitled, in accordance with law and common practice, to:

8.1 Access to Your Personal Information

You have the right to log in, access or edit your username, email address, mobile phone number and personal information in your account at any time. Please refer toAppendix 1: the List of Personal Information Collected by CNKI EXPRESS International Versionfor the information about CNKI's collection of personal information. If you are unable to access to the list, you can contact with us at any time in the manner described in Section 10 of this Policy, and we will respond to your request promptly.

8.2 Correct Your Personal Information

If you find that the personal information you have provided or processed by us is incorrect, you have the right to correct the information through settings in the CNKI EXPRESS International Version. If you are unable to correct the information by yourself, you can contact us at any time in the manner described in Section 10 of this Policy, and we will respond to your request for correction as promptly as possible.

8.3 Delete Your Personal Information

You can delete the nickname, avatar and cell phone number fulfilled at any time. The specific path is as follows: CNKI EXPRESS International Version - "Me" - "Settings" - "Personal Information".

You can access or use the clear function to clear your search history. The specific path is as follows: CNKI EXPRESS International Version - "Home" - "Search Home" - "Clear Search History".

Unless stipulated by laws and regulations, you may contact us to delete your information. You may make a request to us to delete personal information under the following circumstances:

(1)Our processing of the personal information violates the laws or regulations;

(2)We collect or use your personal information without your prior consent;

(3)Our processing of the personal information violates the agreement with you;

(4)You stop using our products or services or you log out of your account;

(5)We no longer provide you with products or services;

(6)Other circumstances stipulated by the laws and regulations.

You hereby agree that once the deletion request is responded, your personal information will be deleted and any information you have provided and the record of actions you have taken will not be retrievable. The relevant information may not be deleted from our backup system immediately but will be deleted when the backup system is updated.

8.4 Cancellation of Account

Unless otherwise stipulated by laws and regulations, or stipulated in this Policy, you may cancel your account through "Me” – “Settings” – “Account Cancellation" to do so. Please read the text instructions on the cancellation page carefully, and begin to cancel your account after you agree. After you submit a request to cancel your account, we will process it duly and revert the result as soon as possible.

To guarantee the safety of your account and assets, please, prior to cancelling your account, check and make sure that the account has met the following requirements: the account is registered by yourself, there is no asset, ongoing transaction or complaint in the account. Your application for account cancellation shall be deemed as your voluntary waiver of all the assets and interests in the account (including the services you have subscribed to but not used up), after-sale service that may be generated from historical transactions and other rights and interests.

Please understand that unless we have retained or stored your personal information in accordance with the laws and regulations or the requirements of regulatory authorities, we will promptly delete your personal information or anonymize it after you cancel your account. Please be aware that we may not delete such information from our backup system immediately but will delete it when the backup system is updated.

It is irreversible for you to cancel your account. Once you cancel your account, we will no longer collect your personal information, nor will we provide you with services of CNKI EXPRESS International Version; all assets and interests generated but not used up in the course of use will be erased, and the content and information under the account will be deleted or anonymized, unless otherwise stipulated by the laws and regulations or stipulated by regulatory authorities. Therefore, we advise that you should be cautious in choosing to close your account.

8.5 Respond to Your Afore-mentioned Request

If you are unable to proceed through the afore-mentioned channels, please contact us through the contact information specified in this Policy. For security purposes, we may ask you to provide relevant information to verify your identity before processing your request. We will respond as soon as possible. We may deny requests that are unnecessarily repetitive, require excessive technical means (for example, a request to develop a new system or make a fundamental change in the existing practice), pose risks to legitimate rights and interests of others, or are highly impractical.

According to the requirements of the laws and regulations, we will not be able to respond to your requests in the following circumstances:

(1)Directly related to national security or national defense security.

(2)Directly related to public security, public health or material public interests.

(3)Directly related to criminal investigation, prosecution, trial, execution of judgment, etc.

(4)Where there is sufficient evidence proving that you have malice or abused your rights.

(5)Responding to your request will cause serious damages to your legitimate rights and interests or those of any other individual or organization.

(6)Where trade secrets are involved.

(6)Other circumstances stipulated by laws and regulations.

9. How Do We Update This Policy

We may update or change this Policy from time to time, and such changes form part of this Policy. We will not impair any of your rights under this Policy without your express consent. We also keep on file the previous version of this Policy for your reference. The previous privacy policy may be obtained by contacting us in the method described in Section 10 of this Policy.

Please read the amended Policy carefully. If you don't agree to this Policy, or any amendment or update to this Policy, you may choose to cancel your account and stop to use CNKI EXPRESS International Version. However, please be aware that this Policy will still govern your activities before your account’s cancellation, and you stop using the service.

With respect to material changes, we will also provide more conspicuous notices, such as conspicuous position notices, pop-up boxes, etc. In such cases, if you choose to continue to use our service, it means that you agree to be bound by the amended Policy. Material changes in this Policy include but are not limited to:

(1)Our service model has changed substantially. For example, the purpose of processing personal information, type of personal information processed and method of using personal information, etc.

(2)We have material changes in the ownership structure and organizational structure. For example, change in ownership due to business adjustment, bankruptcy, merger and acquisition, etc.

(3)Your rights to participate in the processing of personal information and the method of exercising them have changed substantially.

(4) When there is any change in the department responsible for personal information security, contact information or the channels of making complaints.

(5)When the personal information security impact assessment report indicates a high risk.

11. Applicable Law

The Privacy Policy of CNKI EXPRESS International Version and the User Agreement of CNKI EXPRESS International Version together constitute the basic rules governing your use of the CNKI EXPRESS International Version. This Policy is subject to the effective laws and regulations of the People's Republic of China.

If you are not satisfied with our response, in particular if you believe that our processing of personal information has damaged your legitimate rights and interests, you have the right to file a complaint and report to the relevant regulatory authority. Any dispute relating to this Policy shall be resolved by the parties through friendly negotiation. If negotiation fails, you agree that either party could submit the dispute to the Beijing International Arbitration Center for arbitration in accordance with its arbitration rules in force at the time of applying for arbitration. The seat of arbitration is Beijing.

12.1 CNKI EXPRESS International Version’s Lawful Basis for Processing Your Personal Information

CNKI EXPRESS International Version will only process your personal information after obtaining your consent. The types of personal information and the purpose of processing are specified in previous sections. If you have any question regarding our data processing activities, feel free to contact us according to contact information specified in Section 10.

Please note that CNKI EXPRESS International Version may also have the right to process your personal information without your prior consent under the following circumstances in accordance with the GDPR:

(1)processing is necessary for the fulfillment of a contract when the data subject is one of the party(s) or when it is one of the preconditions for the data subject to enter into a contract;

(2)processing is necessary for being compliance with a legal obligation imposed on the controller;

(3)processing is necessary to protect the vital interests of the data subject or of another natural person;

(4)processing is necessary for the public interest or the exercise of official authority vested in the controller;
